Terms & Conditions - the basics

Business Name: Van de Natuur Coffee Selections
 

1. Applicability

These Terms & Conditions apply to all offers, orders, and agreements between Van de Natuur Coffee Selections (“we”, “us”, “our”) and any consumer placing an order through our website within the Netherlands or the European Union.

By placing an order, the customer agrees to these Terms & Conditions.

We operate as:

  • Producer and seller of our own roasted coffee.

  • Retailer of selected third-party coffee products (“Van de Natuur Selected Coffees”).

  • Seller of coffee accessories, including items that may be fulfilled and shipped by  Non EU-based suppliers (dropshipping).

 

We comply with the Dutch Civil Code (Burgerlijk Wetboek), EU consumer law, and ACM (Autoriteit Consument & Markt) guidelines.

2. Products

​

2.1 Roasted Coffee (Our Own Production)

Our roasted coffee is a fresh, perishable food product produced in small batches. Natural variations in taste, aroma, and roast profile occur and are not considered defects.

2.2 Third-Party Coffee Products (“Van de Natuur Selected Coffees”)

Alongside our own coffees, we offer carefully selected specialty coffees produced by third-party roasters or brands.

For these products:

  • We are not the manufacturer.

  • The original producer remains responsible for production quality, labeling accuracy, food safety, and regulatory compliance.

  • We act as the retailer and contractual seller to the consumer.

As required by Dutch consumer law and ACM guidelines:

  • We ensure all product information, origin, allergens, and labeling provided to customers is correct and complete.

  • We handle these products with appropriate storage, freshness protection, and quality control.

  • If a third-party coffee product is damaged, mislabeled, spoiled, or does not meet legal expectations,
    we assist the customer fully and manage the complaint or warranty request with the producer on their behalf.

Statutory consumer rights (“wettelijke garantie”) apply equally to these products.

2.3 Coffee Accessories (Dropshipped & Third-Party Items)

We sell coffee accessories such as grinders, drippers, and kettles. Some items may be fulfilled and shipped directly by our EU-based suppliers.

For these items:

  • We remain the contractual seller responsible toward the customer.

  • We are not the manufacturer.

  • Manufacturer warranties (if applicable) remain valid.

  • We ensure essential product information is clearly provided.

In accordance with Dutch law:

  • We handle all consumer complaints, warranty issues, and defect reports.

  • We mediate directly with the supplier or manufacturer until a legally compliant solution is provided (repair, replacement, or refund).

Dropshipped items may ship separately and arrive in non-branded packaging.

3. Prices & Payment

  • All prices include VAT and are shown in euros (€), unless stated otherwise.

  • Shipping costs are displayed during checkout.

  • Payments may be made via iDEAL, credit/debit cards, PayPal, and other Wix Payments methods.

  • An order becomes binding after successful payment.

We reserve the right to correct any pricing errors.

4. Shipping & Delivery

​

4.1 Delivery Regions & Times

We currently ship to:

  • Netherlands: 5–7 business days ( estimated time)

  • European Union: 7–15 business days ( estimated time)

Delivery times are estimates and not guaranteed. Delays do not entitle customers to compensation.

4.2 Dropshipped Items

When a product ships from an external supplier:

  • Delivery times may differ.

  • Tracking information may originate from the supplier.

  • Packaging may differ from Van de Natuur branding.

  • Orders may arrive in multiple parcels.

We will inform customers when items ship separately.

5. Right of Withdrawal (Herroepingsrecht)

​

5.1 Roasted Coffee — Withdrawal Not Applicable

​

Under Art. 6:230p sub f Burgerlijk Wetboek, the 14-day withdrawal right does not apply to:

“Products that spoil quickly or have a limited shelf life.”

Therefore:
Roasted coffee cannot be returned once dispatched, except where the product is damaged or the incorrect item was sent.

5.2 Accessories & Non-Food Items

Coffee accessories may be returned within 14 days of delivery, provided they are:

  • Unused

  • Undamaged

  • In original packaging

Return shipping costs are the customer’s responsibility unless the product is defective or incorrect.

6. Returns, Replacements & Refunds

​

6.1 Roasted Coffee

Returns are accepted only if:

  • The product arrives damaged,

  • The wrong item was delivered, or

  • A verified quality issue exists.

We will replace the item or issue a refund.

​

6.2 Third-Party Coffee Products

If the product is a food item, the same rules as roasted coffee apply.

6.3 Accessories

Accessories returned under the withdrawal period must be unused and in original condition.

If an accessory is defective, we follow statutory warranty rules and coordinate any repairs or replacements with the manufacturer or supplier.

7. Warranty

​

7.1 Coffee Products

Taste preference is not considered a defect.
We replace products that are damaged, spoiled, contaminated, or incorrectly delivered.

​

7.2 Third-Party Coffee & Accessories

For third-party products:

  • Statutory consumer warranty applies fully.

  • We serve as the primary point of contact for service, warranty, and complaints.

  • We mediate with the manufacturer or supplier on behalf of the customer.

  • Where repair or replacement is not possible, a refund will be provided as required by law.

Manufacturer warranties apply in addition to statutory rights.

8. Liability

To the extent permitted by law, we are not liable for:

  • Indirect or consequential damages

  • Loss of profit

  • Delays caused by carriers or external suppliers

  • Misuse of products

Our maximum liability is limited to the purchase price of the affected item.
These limitations do not apply in cases of intent or gross negligence.

9. Third-Party Fulfillment & Data Sharing

To complete orders, we may share address details with logistics partners and dropship suppliers.

By placing an order, the customer agrees that:

  • Their address and contact details may be shared solely for shipping purposes.

  • Products may arrive in multiple shipments.

  • Packaging may differ from Van de Natuur branding.

We remain fully responsible as the contractual seller.

10. Privacy & Data Protection (GDPR)

We process personal data only for:

  • Order processing

  • Payment handling

  • Shipping and delivery

  • Customer service

  • Legal and tax obligations

We do not sell personal data to third parties.
We share personal data only with service providers essential for fulfilling the order (e.g., carriers, dropship suppliers).

Data is handled in accordance with the General Data Protection Regulation (GDPR) and Dutch privacy law.

11. Governing Law & Disputes

These Terms & Conditions are governed by Dutch law.
Disputes will be resolved by the competent Dutch court in the customer’s place of residence, unless mandatory law dictates otherwise.

12. Changes to Terms & Conditions

We may amend or update these Terms & Conditions at any time.
The version applicable to a purchase is the version in effect at the time the order is placed.
